Some Things That Need To Be Clarified

“Sailing Adventure Vacations”, “SAV” “Sailing School”, is simply represented by “we”, “our”, “ourselves” and “us” which means Sailing Adventure Academy LLC dba Sailing Adventure Vacations.

“Participant”, “you”, “your” and “yourself” means the individual, person, persons, or individuals who have registered to take a sailing class/course/event or any other event with Sailing Adventure Vacations.

The receipt of payment for any deposit shall put into motion an acceptance to all the provisions contained herein.

The Deposit and/or Initial Payment

A deposit of 50% of the class/event charges is needed to obtain the booking of a sailing class/course/event. The balance is due 30 days before the sailing class/course/event start date. Bookings made within 60 days of the sailing class/course/event date require full payment, unless satisfactory arrangements have been made and agreed upon. Payment is accepted by VISA, MasterCard, American Express, money order, wire transfer, cashier’s check, or any other form of payment that is deemed acceptable and agreed upon by all parties.

Cancellation by Participant

If you cancel a reservation you have made with us, the deposit and sailing class/course/event fee are non-refundable and cannot be applied to another sailing class/course/event or date, except: If the cancellation occurs at least 60 days prior to the scheduled departure date and a cancellation fee of 10% of the full sailing class/course/event fee will be charged and the balance of your deposit refunded.

Cancellation by SAV

Sailing Adventure Vacations may cancel any sailing class/course/event at any time before departure for any reason, including sickness, accidents, mechanical breakdown, war or civil disturbances, travel delays, strikes, or insufficient participants to operate the class/course/event. Sailing Adventure Vacations will make every effort to follow the accepted and/or agreed itinerary, but there may be circumstances and/or factors beyond our control. If a sailing class/course/event is cancelled, Sailing Adventure Vacations will make every effort to find a suitable replacement, but our liability is limited to a refund of payment made.

Hurricane Warning and Tropical Storm Conditions Policy

A Hurricane Warning and/or Tropical Storm Advisory conditions are routine and posted frequently during specific times and seasons. If during your sailing class/course/event or at a time that may affect your sailing class/course/event, a warning or hurricane watch, or tropical storm advisory is issued for the area you are sailing, we may be forced to cancel the sailing class/course/event and you will be issued a rain check for the unused portion of your class. If a sailing class/course/event is cancelled due to weather no refunds will be issued.

Travel Insurance

If you cancel a sailing class/course/event within 60 days of the departure date no refunds will be issued. This is a good example of why the purchase of travel insurance can be important to you and others. It covers cancellation as a result to medical reasons/issues, unknown or unpreventable circumstances such as an airline strike or other default, weather, plus a whole range of issues, therefore, it is strongly advised that you consider purchasing some form of travel insurance. If you choose not to take or purchase travel insurance, you clearly accept any financial loss associated with your travel itinerary.

Refunds and Adjustments

Should you need to leave the sailing class/course/event before it is complete, due to sickness, family emergency or any other reason, no refunds or adjustments can be made for any unused portion of the sailing class/course/event.

If the sailing boat/vessel should be stranded, lost, or disabled by act of God, fire, perils of the sea, or by any other accident rendering the boat/vessel unfit for use, and the incident is not brought about by act or fault of the Participant, the Sailing School shall cease from the time thereof and neither you or SAV shall be liable for the loss, damage, expense, or inconvenience therefrom.

Consuming Alcohol While Onboard Boat/Vessel

Sailing Adventure Vacations boats/vessels are operated as what may be termed to be a dry boat/vessel when underway and possibly at anchorages. When the boat/vessel is in port, when it is moored or at anchor, reasonable amounts of alcohol may be consumed, but excessive alcohol consumption that leads to situations of having people at risk, or where the actual harmony of life and routine on board is disturbed to a level where other guests may feel uncomfortable, will not be accepted or tolerated in any way. If this situation occurs, the Captain and/or sailing instructor reserves the right to return to port and to disembark any Participant at an intermediary port, or disembark the entire group in a group if necessary. Sailing Adventure Vacations will not reimburse, or in any way be held responsible for any costs incurred for travel or any other expenses.

Illegal Acts and the Use of Illegal Drugs or Other Substances

No illegal drugs, substances, objects or contraband may be brought onboard the boat/vessel. Any person found in the possession of or under the influence of any illegal substance will be removed from the sailing class/course/event and vessel immediately regardless of location, and Sailing Adventure Vacations will not reimburse, or in any way be held responsible for any costs incurred for travel or any other expenses. In addition, you shall indemnify SAV and the Captain against all legal action, impounding and loss incurred as a result.

Participant Conduct While Onboard Sailing Class/Course/Event Vessels

If, in our opinion, your individual conduct jeopardizes the safety or endangers the boat/vessel or any other person or property on board, or you behave in a disorderly manner or in a manner to which other Participants may reasonably object, we reserve the right to take such measures to prevent continuation of such conduct, including your removal from the vessel. In such an instance, no refunds will be issued and Sailing Adventure Vacations will not reimburse, or in any way be held responsible for any costs incurred for travel or any other expenses. You agree to abide by the orders of the Captain and/or Sailing Instructor in command of the Sailing Class/Course/Event boat/vessel at all times.

Smoking While Onboard Boat/Vessel

We insist that “No Smoking” privileges be observed while onboard the boat/vessel. If you find it necessary to smoke, use of the leeward deck may be permitted, as long as you make every effort to stay downwind from other Participants on the boat/vessel. Below deck smoking is strictly prohibited at all times.

Responsibilities of Each Participant

Unless otherwise specified, all Participants will be expected to participate in the cooking, cleaning of the vessel and routine/spot maintenance as required by the Instructor. At the end of the sailing class/course/event, the Participants are expected to clean the vessel and leave it in the same condition as when starting the class/course/event.

Participant Liability

You agree to be responsible for, and to replace and make good, any injury to the boat/vessel, its furnishings and equipment caused by you, or any of your party, less any wear and tear. Limits of your liability for any injury to the boat/vessel and the equipment is the deductible amount on the insurance hull coverage carried on the vessel, per incident.

Health of Individual Participants

Each and every sailing class/course/event participant certifies that they do not have any condition or disability that would create any kind of hazard/hardship for themselves individually or any other participants taking part in the sailing class/course/event. Every participant understands and acknowledges the fact that certain health care standards, local hospitals, facilities and other services at sea and/or ashore may not be suitable or are inadequate for the treatment of certain health conditions.

Sailing Adventure Vacations makes no representations or warranties and disclaims any made regarding special accommodations or handicap accessibility on any sailing class/course/event. While we will make every effort to work with and accommodate every individual/participant, Sailing Adventure Vacations reserves the right to decline accepting or retaining any Participant whose health or actions in Sailing Adventure Vacations’s sole judgment may impede the operation of a sailing class/course/event or the welfare or enjoyment of fellow Participants.

Age Limits

We cannot accept Participants under the age of 18 unless accompanied by a legal parent/guardian. There is no actual upper age limit that is in place, but it will be the Participant’s sole responsibility to satisfy themselves that they are able and fit to join their chosen sailing class/course/event.

Required Documents for Travel

Each and every sailing class/course/event participant is responsible to obtain and carry a valid passport and any necessary visa(s), and any other documents required by applicable government agencies according to their regulations. Non-US residents may require specific or special travel documents. Please check your status with local officials and any embassy or consulate officials.

You clearly understand that Sailing Adventure Vacations reserves the right to take photographic or film records of any of its class/course/events, and hereby agree that we may use any such photographic or film records for promotional and/or commercial purposes without any remuneration to you. You agree to assign all right, title and interest you may have in or to any media in which your name or likeness might be used to Sailing Adventure Vacations.

Private/Personal Boat Instruction

If any private/personal instruction is to take place on your boat/vessel, a separate terms and conditions policy will be made available to you.

Please Note:  Sailing Adventure Vacations reserves the right to make any changes, alterations, additions, or modifications to our Terms and Conditions.  These changes, alterations, additions, or modifications will happen on this page and an update of the process will be recorded as the “Last Date of Modification”
